IMS Terms and Conditions of Use are set our below and apply to:
• Those who access and use our website;
• Those who request a quote from IMS;
• Those who engage our services;
• Those who undergo a procedure facilitated by IMS.
Accuracy, Currency and Completeness
To the extent permitted by law IMS does not warrant the accuracy, completeness or currency of any information or material available on or through our website or publications distributed by IMS. Including information provided by third parties for display on our website. Despite reasonable efforts that will be made to ensure material provided is accurate, complete and up-to-date such information may change without notice or not be exactly applicable to your circumstances. To the extent permitted by law IMS will not be liable for any loss or damage you incur as a result of acting in reliance on such information or material.
You warrant that where you provide IMS with personal information or personal medical records or photographs that you are the owner or authorised user of such materials.
You warrant that you are over 18 years of age and are not otherwise prevented from entering into a legal and binding contract.
You warrant that you will follow your doctors’ advice and recovery instructions.
IMS will at all times endeavour to keep your personal information secure and private. IMS employs procedures and security products recommended to IMS by Information Technology consultants, however no information transmitted over the internet can be guaranteed as being secure.
To the extent permitted by law IMS will not be liable for any loss or damage you incur as a result of any breach of IMS security as you accept the nature of risk inherent in information stored and distributed to authorised third parties and contractors through the internet.
Any health related information provided to you by IMS through and by this website, IMS employee consultations, third party websites and contractors is for general information purposes only and is not to be relied on as a substitute for professional medical advice or professional care providers.
Intellectual property rights in the materials on this website and in materials written and distributed by IMS are owned by IMS. It is for your personal, non-commercial use only.
Other than for purposes permitted by the Terms and Conditions of IMS you must not copy, adapt, reproduce, publish or modify any such intellectual property without the prior written consent of IMS.
IMS’ (exclusion of) liability
To the extent permitted by law IMS excludes all warranties (whether expressed, implied or statutory) relating in any way to this website and other materials distributed by IMS.
IMS is not liable for:
• The reliance on such information;
• Any failure or delay in providing you with information or services;
• Direct or indirect loss, howsoever caused including negligence.
Disclaimers and General Conditions
IMS requires all users of this website and services to read the Terms and Conditions carefully.
IMS reserves the right to alter these Terms and Conditions at any time without notice to you. Your continued use of IMS’ website and services will be taken of your acceptance of the Terms and Conditions at that point in time.
Medical and Travel Insurance
It is a condition of your agreement with IMS that you will take out travel insurance prior to departure for your procedure and that you will provide the insurer with full disclosure of all relevant matters, including but limited to the elective surgery you will undergo (subject to your eligibility) whilst overseas.
IMS may request confirmation of such insurance.
IMS is a coordinator of tours facilitating our clients to engage with medical professionals in other countries to assess their suitability for and where able to carry out medical procedures.
Other than making information available to you, and introducing you to third party providers of goods and services IMS is not providing you with any goods or services in the capacity of principal. The third party principals that we introduce you to from Bangkok Hospital Pattaya to assess your suitability for and carry out the medical procedures are not sub-contractors of IMS.
Ancillary goods and services provided to you by third party principals may include travel agents, insurance brokers, hotels, meals, activities and consultations are not provided by sub-contractors to IMS.
No IMS employee, directors, nurses or other staff are qualified to provide you with medical advice in relation to any medical procedure requested.
Acknowledgement of risk
You acknowledge that any medical procedure, medical advice or other service (including ancillary services) that you request IMS to book on your behalf carries inherent risk wherever it is provided.
You acknowledge that the general care, standards and procedures employed by third party providers providing you with a service booked through IMS will differ to the general care, standards and procedures that would apply should those services have been carried out in Australia.
You acknowledge that procedures may not be successful, may cause injury or have unwanted side effects.
Whilst every care is employed to ensure the high standard of all third parties IMS introduces you to, you should check the terms and conditions and exclusions of liability that applies to each third party provider.
A pre consultation fee of $250 (GST inclusive) payable during the client consultation via credit card or direct debit; A service and administration fee of $500 (GST exclusive) payable by the client after IMS has received confirmation from Bangkok Hospital Pattaya on the client’ medical procedure;
Post consultation is provided free of charge;
All payments made via credit card will incur a 3% credit card surcharge fee;
All fees are non refundable.
IMS complies with the Privacy Act 1988 (Cth) and applicable health records laws to protect your privacy and any personal information that we collect in offering our services to you (including your sensitive health information and records).
Collecting your personal information
At the time of requesting a quote from IMS, you are not obliged to provide us with any personal or identifying information.
In order to proceed with our services and for us to offer you a detailed quote and discuss your suitability for any procedures, we will need you to provide us with and we will collect the information requested on our enrolment form.
We may also need to collect information about you from third parties, such as your local treating Doctor where it is not reasonable or practical to collect that information directly from you.
Storing your personal information
Your information will be stored on our business systems that we will endeavour at all times to keep secure and safeguarded to protect your privacy using products and procedures recommended to us by our Information Technology consultants.
Using your personal information
We will use your personal information to make contact with you in the ordinary course of carrying out our business. Such situations where we may utilise your personal information include but are not limited to:
• To respond to and facilitate your request for information and services, including booking travel and accommodation (overseas), establishing your suitability for the procedure/s you have requested and managing your account with BHP and with IMS;
• To assist us to develop new products and services and grow our client base (you will be provided with an “opt out” option in such communications);
• To offer you new products and services that we believe may be of interest to you (you will be provided with an “opt out” option in such communications) and including the administration of promotional programs;
• To contact you to amend and update our client records where necessary;
If you would not like us to use your personal information to contact you, please use the “opt out” option provided to you or contact us immediately and we will endeavour to comply with your request. There may be circumstances where we will not be able to continue to assess your suitability for or facilitate your requested procedure/s without the ongoing storage and use of your personal information.
By completing and returning the Enrolment Form to us we will take it that you agree to and consent to our gathering, storing and using your personal information, so long as we comply with the relevant laws.
Disclosing your personal information
In using your personal information in the normal operation of our business your personal information may be passed on (including outside of Australia) to:
• Our agents, contractors and service providers (including Bangkok Hospital Pattaya) who assist us to provide our services to you;
• Others who will be involved in your care;
• In additional ways that you may also agree to.
We will take steps to ensure that when your personal information is shared in the circumstances as outlined that those in receipt of your information treat it the same way that we would. We do however bring to your attention that many such agents, contractors, service providers and others may be bound by Thai jurisdiction and not the same privacy legislation that applies in Australia.
Where possible, in the above circumstances we will remove your personal identity from the information that is disclosed so as to protect your privacy. This may not always be possible or practicable.
Where we are required to pass on your personal and private information as required by law (Australian or Thai) we will comply with that directive.
We will delete personal information that we are no longer required to store by law or for normal business purposes.
